Terms of Service

These Terms of Service govern your use of GoNow, the AI productivity coaching service operated by Daniel AI LLC, a Delaware corporation. By creating an account or using any GoNow feature, you agree to be bound by these Terms in full. If you do not agree with any provision, please do not use the Service. These Terms comply with applicable consumer protection, subscription billing, and AI transparency laws in all jurisdictions where GoNow operates.

1. About GoNow

GoNow is an AI-powered productivity coach. It uses artificial intelligence — specifically Google’s Gemini language model — to provide text and voice coaching conversations that help you build better habits, set goals, and improve your daily productivity. You are always interacting with an AI system, not a human being. This is clearly disclosed throughout the service in compliance with EU AI Act Article 50 transparency requirements (effective February 2025), South Korea’s AI Framework Act (effective January 22, 2026), the Colorado AI Act consumer notification obligation (effective June 30, 2026), and FTC Section 5 guidance on truthful AI representations. GoNow does not perform emotion recognition, sentiment-based behavioral scoring, or social scoring — practices that are prohibited or restricted under the EU AI Act Article 5. GoNow is not a medical, psychological, therapeutic, financial, or legal service. It cannot diagnose conditions, prescribe treatments, provide crisis intervention, or offer professional advice of any kind. AI-generated coaching suggestions may be helpful but should never replace professional guidance. If you are in crisis or need emergency help, please contact your local emergency services immediately.

2. Accounts, Plans & Billing

You can try GoNow with limited features without an account. Paid plans — Standard ($6.99/mo), Pro ($19.99/mo), and Ultra ($39.99/mo) — are billed through Stripe monthly or annually. Subscriptions auto-renew unless cancelled. We send renewal reminders at least 3 days before each renewal, as required by the California Automatic Renewal Law and New York General Business Law. Cancel anytime with one click in your account settings. EU users: 14-day right of withdrawal under the Consumer Rights Directive (2011/83/EU). South Korean users: 7-day withdrawal under the Act on Consumer Protection in Electronic Commerce. Contact legal@gonowtimesaver.com for withdrawals. After cancellation, access continues until the end of your current billing period. Payments are non-refundable except where statutory withdrawal rights apply.

3. Voice Credits

Voice credits power voice coaching sessions. One credit equals one minute. Purchased credit packs never expire, remain in your account until used, and are non-refundable. Monthly credits included with Pro (150/mo) and Ultra (300/mo) plans reset each billing cycle and do not carry over.

4. AI & Service Limitations

GoNow uses Google Gemini AI, which may occasionally produce inaccurate, incomplete, outdated, or contextually unsuitable responses. Always apply your own judgment and independently verify any important information before acting on it. We do not guarantee specific productivity outcomes; your results depend entirely on your own effort, circumstances, and decisions. GoNow does not make consequential decisions as defined by the Colorado AI Act — meaning it does not determine outcomes affecting your education, employment, healthcare, housing, insurance, financial services, or legal rights. It provides coaching suggestions only; you make all final decisions yourself. Under South Korea’s PIPA, you may request a plain-language explanation of how automated coaching responses are generated, and you have the right to refuse decisions based solely on automated processing. Under the EU AI Act, GoNow is not classified as a high-risk AI system because it does not make decisions in the domains listed in Annex III. We will formally reassess this classification before August 2, 2026, when the full high-risk system obligations take effect. Under California’s CPRA automated decision-making technology (ADMT) regulations effective January 2026, you may request information about how AI processing affects your coaching experience and opt out of automated profiling. Service features, pricing structure, or availability may change; active subscribers receive at least 30 days written notice before any material changes take effect.

5. Your Data & Content

You own your conversation data. We process it solely to deliver and improve your personal coaching experience. You can delete your data at any time from your account settings — no approval process, no waiting period. You have the right to export your complete data in machine-readable JSON format by contacting privacy@gonowtimesaver.com. EU and UK users have full data portability rights under GDPR Article 20, including the right to receive data in a structured, commonly used format and to transmit it to another controller. South Korean users may request data portability to another service provider under PIPA effective March 2025. Brazilian users have data portability rights under LGPD Article 18(V). Canadian users may request access to all personal information we hold under PIPEDA Principle 9. After account deletion, your data remains recoverable for 30 days in case of accidental deletion, then is permanently and irreversibly erased from all systems including primary databases and vector search indexes. Billing records are retained only for the minimum period required by applicable tax law. Complete details about data handling are in our Privacy Policy.

6. Rules & Termination

Do not use GoNow for illegal purposes, unauthorized system access, transmitting harmful code, or impersonation. Do not rely on the AI for emergency mental health situations — contact local emergency services. We may terminate accounts that violate these Terms immediately and without notice. Terminated users forfeit remaining subscription access.

7. Third-Party Services

GoNow operates through Stripe (payments), Google Gemini (AI), ElevenLabs (voice), Supabase (database), and Cloudflare (hosting). Their terms of service also apply to your use. We are not liable for third-party service disruptions or changes.

8. Liability & Warranty

GoNow is provided as-is without warranties of any kind, express or implied. To the maximum extent permitted by law, Daniel AI LLC is not liable for indirect, incidental, special, or consequential damages. Maximum liability is limited to fees you paid in the 12 months preceding the claim. Nothing in these Terms limits liability that applicable law prohibits limiting, including mandatory EU and UK consumer protections.

9. Intellectual Property

The GoNow name, logo, design, and underlying technology are the intellectual property of Daniel AI LLC, protected by applicable copyright, trademark, and trade secret laws. AI-generated coaching responses are created dynamically using third-party language models and are provided for your personal use. You may freely use, save, and reference any coaching content generated for you. However, AI-generated outputs are not guaranteed to be unique, original, or free from factual error, and Daniel AI LLC makes no copyright or ownership claims over AI-generated text delivered to you. You retain full ownership of all content you provide to GoNow, including conversation messages, uploaded data, and profile information. By using GoNow, you grant us a limited, non-exclusive, revocable license to process your content solely for the purpose of delivering and improving your personal coaching experience. This license terminates immediately when you delete your data or close your account. We never use your content for advertising, marketing to third parties, or any purpose unrelated to your coaching.

10. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Do not share your login information with anyone. If you suspect unauthorized access, notify us immediately at security@gonowtimesaver.com and change your password. We implement industry-standard security measures including encryption, row-level data isolation, and secure authentication, but no system is perfectly secure. One account per person; account sharing may result in service limitations or termination. By creating an account, you consent to receive electronic communications from us regarding your account status, service updates, billing confirmations, and legally required notices. This consent satisfies the requirements of the US Electronic Signatures in Global and National Commerce Act (ESIGN), the EU eIDAS Regulation, South Korea’s Act on Electronic Documents and Transactions, and equivalent electronic transaction laws in other jurisdictions. You may opt out of non-essential promotional communications at any time through your account settings without affecting your service access.

11. Dispute Resolution

We want to resolve any disagreement quickly and fairly. If you have a concern about the Service, please first contact us at legal@gonowtimesaver.com with a clear description of the issue. We commit to working in good faith to resolve it informally within 30 days. If informal resolution is unsuccessful, either party may pursue the remedies available under applicable law in the appropriate jurisdiction. We do not require mandatory arbitration or class action waivers because we believe dispute resolution should be fair and accessible to everyone. EU consumers may use the European Commission’s Online Dispute Resolution platform. South Korean consumers may file complaints with the Korea Consumer Agency, the Personal Information Dispute Mediation Committee, or PIPC. Brazilian consumers may seek resolution through the consumer.gov.br platform or local PROCON offices. Canadian consumers may contact the Office of the Privacy Commissioner. Nothing in these Terms limits your statutory right to bring individual claims in small claims court, to file complaints with any regulatory authority, or to exercise any non-waivable consumer protection rights under your local law.

12. General & Contact

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. However, mandatory local consumer protection laws always apply regardless of this choice of law. EU consumers retain the right to bring proceedings in their country of habitual residence under Regulation (EU) 1215/2012 and benefit from protections under the Consumer Rights Directive and Unfair Contract Terms Directive. UK consumers retain protections under the Consumer Rights Act 2015 and the Data Use and Access Act 2025. Brazilian consumers retain protections under the Consumer Defense Code. If any provision of these Terms is found unenforceable by a court of competent jurisdiction, that provision is modified to the minimum extent necessary and the remainder continues in full force and effect. We may update these Terms to reflect legal changes, new features, or operational needs; active subscribers receive at least 30 days written advance notice of any material changes. Continued use after the effective date of changes constitutes your acceptance of the updated Terms. Age requirements: users under 13 years old are prohibited worldwide in compliance with COPPA. Users aged 13 to 15 require verifiable parental consent under GDPR Article 8 and equivalent laws. Users 16 and older may use GoNow independently. We do not use your personal data to train general-purpose AI models. We do not sell personal data as defined by any applicable law. In compliance with Connecticut’s disclosure requirements effective July 1, 2026, we confirm that no personal data collected through GoNow is used for large language model training.
